Again we have confusion and misleading info regarding Trump’s constitutional authority to make the strike.
This has been an issue even our Founders debated.
Our Constitution is not and never can be totally clear on every possible scenario.
In this case it is easy to establish his authority.
Article 1 & 2 both mention war powers.
Article 1, section 8, clause 11 says Congress declares war.
Article 2, section 2 has as much weight and establishes POTUS as Commander in Chief. In doing so it was assumed the President guides military actions after declaration of war. Always true.
This issue has been enough of a problem Congress had to revisit it in 1973 and created the War Powers Resolution. (Act)
By the War Powers Act the President can order action but must report the action to Congress within 48 hours.
That Act further states POTUS must refer to Congress to commit troops past 60 days engagement. He is granted another 30 for withdrawal for a total commitment of 90 days max.
The action in Syria is not a declaration of war or intent to begin a war. It is, at best, a retaliatory strike for violating longstanding international law.
There is no commitment of engaged troops.
There was a strike completed with no commitment of troops.
Anyone telling you the President did not have authority, legal and constitutional, to order the strike on Syria is not correct.
